Terms of Sale

These Terms of Sale govern the subscriptions offered on dunelia.com, with monthly or advance payment according to the chosen plan. They apply to every order placed by a registered User.
1. Purpose
These Terms of Sale define the conditions under which SAPENSE sells DUNELIA's paid services, namely:
- Individual plans: one active text, photo or video slot
- Packs: several active slots of each type grouped in a single subscription
- Recipient Access: a subscription taken out by an heir after the User's death to retain access to the file personally transmitted to them
Each slot holds one item of the specified content type at a time. Slots are neither renewed nor added each month: their capacity remains constant throughout the subscription.
2. Prices
2.1 Display of prices
Prices are shown in euros (€), inclusive of all taxes on the Our plans page. DUNELIA reserves the right to change its prices at any time. Price changes do not apply to orders already confirmed or to existing subscriptions.
2.2 Plans and packs
The monthly prices currently available are as follows:

Prices may change. The prices in force at the time of the order apply.
2.3 Pack durations and discounts
The chosen pack's monthly price is the basis for calculation. The options offered are: monthly payment without a commitment or discount; monthly payment with an initial twelve-month commitment and a 20% discount; three months paid in advance with a 5% discount; six months paid in advance with a 15% discount; one year paid in advance with a 30% discount. The total amount due, payment frequency and discount are stated again before payment.
3. Orders
3.1 Ordering process
To place an order, the User must:
- Be registered and signed in to their DUNELIA account
- Have verified their email address
- Select the desired plan
- Make payment through the secure Stripe platform
A summary of the plan, its price and payment frequency is shown before redirecting to Stripe. The order is confirmed once payment has been validated.
3.2 Confirmation
Acceptance of these Terms of Sale is obtained before payment. Slots become available once Stripe confirms payment.
4. Payment
4.1 Payment methods
Payments are processed securely by Stripe. The accepted payment methods are:
- Payment card (Visa, Mastercard, American Express)
- PayPal
4.2 Payment security
DUNELIA does not store any payment card numbers. Transactions and payment data are processed by Stripe on its infrastructure.
4.3 Billing
Payment is automatically charged on the corresponding renewal date according to the chosen frequency: monthly, every three months, every six months or every twelve months. For advance payment, the entire period is charged at its start. The User can view their payment history in their Stripe space.
5. Subscriptions
5.1 Duration and renewal
Subscriptions renew automatically at the chosen frequency unless cancelled by the User. The monthly plan with a commitment has an initial minimum term of twelve months, then continues monthly. Prepaid plans renew for an identical period of three, six or twelve months.
5.2 Slots
Slots are not monthly credits: they do not accumulate and remain available while the subscription is active. Deleting content frees up the corresponding slot during the active period.
5.3 Cancellation
The User can request cancellation from their dashboard (“My subscription”). Without a commitment or with advance payment, cancellation takes effect at the end of the period already paid for. For the monthly plan with an initial twelve-month commitment, a request made before the end of that term is scheduled for that date and monthly payments remain due until then, subject to statutory rights to early termination:
- The User retains access to the Service until the end of the paid period
- No pro rata refund will be made
- Slots remain active until the end of the paid period
- Cancellation does not automatically delete the account or previously uploaded content
5.4 Changing plans
The Service does not currently perform automatic plan changes with pro rata adjustment. The User may take out a new plan and then cancel the previous one from their dashboard.
6. Individual plans and packs
Individual plans remain billed monthly without a commitment. For packs, the User chooses between monthly billing without a commitment, monthly billing with an initial twelve-month commitment, or advance payment for three, six or twelve months. A pack combines several text, photo and video slots. Multiple active subscriptions add their capacities together.
6a. “Recipient Access” plan
When a death has been verified and transmission is opened, DUNELIA creates an individual file for each designated heir, containing a copy of only the content personally intended for them.
When a collection is released, each recipient receives six months of free access to their collection. After that, access is maintained only with a Recipient Access subscription, taken out individually by each recipient for their own collection.
- Six free months: access to the file is free for six months from its opening. No payment method is requested during this period. A warning email is sent no later than one month before expiry.
- Individual subscription: after these six months, access is maintained only through an “Recipient Access” subscription taken out by the heir for their own file. One subscription covers only one file and does not maintain any other heir's access.
- Recovery period: without a subscription, access is suspended but content is retained for another six months. Subscribing during this period immediately restores access to the complete file.
- Advance notice and retention: at the end of this period, a deletion notice is sent to the heir, after which the file is retained for a further six months without online access, to allow any claims to be made.
- Permanent deletion: after this final period, the file's content is permanently deleted with no possibility of restoration. The deceased's original content is deleted when no heir's file entitles it to be retained.
- Heir under 18: a minor heir's file is stored free of charge and cannot be viewed until they come of age. The six free months and the subsequent periods above begin only on that date.
Cancellation of an “Recipient Access” subscription takes effect at the end of the paid period. The heir then has a new six-month window to restore access to their file before the deletion notice is sent.
7. Right of withdrawal
Subject to the exceptions provided for by law, consumers have fourteen days to exercise their right of withdrawal. When the User requests immediate activation of the Service before this period ends, their express agreement and acknowledgement of the consequences for their right of withdrawal are obtained separately before payment.
The order summary makes it possible to confirm, in particular, that:
- activation of the slots is requested immediately after payment;
- the Terms of Sale and Terms of Use have been read and accepted;
- evidence of these choices is timestamped and retained.
The precise legal classification of the Service and the scope of the exception to the right of withdrawal must be confirmed by a legal professional.
8. Refunds
Where a statutory exception to the right of withdrawal applies following a request for immediate performance:
- a subscription period that has started is not refunded pro rata after cancellation;
- cancellation stops future renewals at the end of the paid period or the applicable initial commitment.

9. Liability
DUNELIA undertakes to provide the Service with due care and in accordance with professional standards. If access to the Service is temporarily unavailable, DUNELIA cannot be held liable for indirect losses (data loss, non-material damage, etc.).
DUNELIA's total liability, for all causes combined, is limited to the total amount paid by the User during the previous 12 months.
10. Force majeure
DUNELIA cannot be held liable for total or partial failure to perform its obligations where such failure results from a force majeure event as defined by Article 1218 of the French Civil Code (natural disaster, war, pandemic, widespread network outage, etc.).
11. Mediation
After a prior written complaint remains unresolved, the consumer may refer the matter free of charge to the consumer mediator designated by SAPENSE.
12. Governing law
These Terms of Sale are governed by French law. In the event of a dispute, and failing an amicable resolution or mediation, the competent courts for the location of SAPENSE's registered office shall have exclusive jurisdiction.
