Terms of Use

These Terms of Use govern access to and use of dunelia.com and its services. By creating an account or using the website, you accept these Terms of Use without reservation.
1. Definitions
- “Website”: the website available at dunelia.com
- “Service”: all the features offered by DUNELIA
- “User”: any person registered on the Website
- “Message”: any content (text, video or photo) uploaded by the User to the platform
- “Beneficiary”: a person designated by the User to receive a Message
- “Publisher”: SAPENSE, the company that publishes the Website
2. Purpose of the Service
DUNELIA is a private digital legacy space that allows Users to write and store texts, photos and videos and link them to Beneficiaries. No content is automatically released following a death report.
3. Registration and account
3.1 Registration requirements
- Registration is open to any individual aged at least 18
- The User must provide accurate and up-to-date information
- Email address verification is mandatory to access the Service's features
- Registration is available through a standard form or Google OAuth
3.2 Account security
The User is responsible for keeping their login credentials confidential. All activity carried out through their account is deemed to have been performed by them. If unauthorised use is suspected, the User must immediately notify DUNELIA at contact@dunelia.com.
4. Use of the Service
4.1 Permitted uses
The Service is intended exclusively for creating and preserving personal posthumous messages. The User undertakes to use the Service in accordance with its purpose and these Terms of Use.
4.2 Prohibited uses
It is strictly prohibited to:
- Use the Service for unlawful, fraudulent or malicious purposes
- Upload unlawful content (incitement to hatred, child sexual abuse material, glorification of terrorism, etc.)
- Use the Service to harass, threaten or defame anyone
- Attempt to bypass the Website's security measures
- Collect other users' personal data
- Use bots, scrapers or any automated means to access the Service
- Resell or transfer access to your account
- Upload content that infringes third parties' intellectual property rights
4.3 User content
The User retains all intellectual property rights in the content they upload. They authorise the technical operations strictly necessary to store it, display it in their account and, where applicable, prepare it for an authorised transmission.
DUNELIA does not analyse content for advertising purposes. However, authorised administrators may access it when necessary for support, security, compliance with a legal obligation or the manual handling of a transmission file.
5. Slots and subscriptions
Creating an account is free. Creating and storing content requires slots provided by an individual subscription or a pack, in accordance with the Terms of Sale.
Each slot holds one item of the specified content type at a time. Deleting content frees up its slot. These capacities are not a balance of monthly credits and do not accumulate at each renewal.
6. Transmission process
6.1 Verification of death
A death must be reported to DUNELIA. An authorised administrator then reviews the report; nothing is sent automatically. The public report currently requires a supporting document, checked in an area reserved for authorised administrators.
6.2 Transmission arrangements
The Service does not trigger any automatic transmission: an authorised administrator decides to open transmission after verifying the death. An internal status alone does not constitute evidence of actual delivery to the Beneficiary.
Once this decision has been made, the Service creates an individual file for each recipient Beneficiary, containing a copy of only the Messages addressed to them, and sends them a personal access link at the email address provided by the User during their lifetime. A Beneficiary never has access to another Beneficiary's file.
The User is responsible for the accuracy of each Beneficiary's email address and, where applicable, date of birth. DUNELIA cannot be held liable for being unable to contact a Beneficiary whose details are incorrect or out of date.
6.3 Beneficiaries' access period
When a collection is released, each recipient receives six months of free access to their collection. After that, access is maintained only with a Recipient Access subscription, taken out individually by each recipient for their own collection. The applicable access, recovery and retention periods, and what happens to content when they expire, are detailed in the Terms of Sale and on the page Transmission.
A minor Beneficiary's file is stored free of charge and sealed until they come of age.
7. DUNELIA's liability
7.1 Obligation to use reasonable efforts
DUNELIA undertakes to use all reasonable means to ensure the proper operation of the Service, the security of data and the preservation of Messages. This is an obligation to use reasonable efforts, rather than to achieve a guaranteed result.
7.2 Limitations
DUNELIA cannot be held liable for:
- Temporary interruptions to the Service due to maintenance or force majeure events
- Data loss resulting from force majeure or a malicious act by a third party
- Inaccurate information provided by the User (in particular Beneficiaries' contact details)
- Being unable to contact a Beneficiary because of an invalid email address
- The content of Messages uploaded by Users
8. Suspension and termination
8.1 By the User
The User may delete their Messages individually from their space. Self-service account deletion is not yet available in the settings; an erasure request may be sent to contact@dunelia.com. Some data may be retained where required by a legal obligation or to defend legal rights.
8.2 By DUNELIA
DUNELIA reserves the right to suspend or delete an account in the event of:
- A breach of these Terms of Use
- Abusive or fraudulent use of the Service
- Uploading unlawful content
- Non-payment of amounts due
No refund is due in the event of suspension or termination for a breach.
9. Intellectual property
All elements of the Website (design, text, graphics, logos, source code, etc.) are the exclusive property of SAPENSE and are protected by intellectual property laws. Any unauthorised reproduction or use is prohibited.
10. Data protection
DUNELIA undertakes to protect its Users' personal data in accordance with the GDPR. Details are available in our Privacy Policy.
11. Service availability
DUNELIA endeavours to keep the Service accessible 24 hours a day, 7 days a week. However, access may be temporarily interrupted for maintenance, updates or in cases of force majeure. DUNELIA will inform Users of scheduled maintenance whenever possible.
12. Changes to the Terms of Use
DUNELIA reserves the right to amend these Terms of Use at any time. Users will be informed of any material change by email or a notification on the Website. Continued use of the Service after notification constitutes acceptance of the new Terms of Use.
13. Governing law and jurisdiction
These Terms of Use are governed by French law. In the event of a dispute, the parties undertake to seek an amicable solution. Failing this, the competent courts for the location of SAPENSE's registered office shall have exclusive jurisdiction.
